Terms of Service

1. The Service

Karbasa is a professional design tool for graphic designers. It includes a design editor, cloud storage for your files and assets, and features that use artificial intelligence ("AI features"). Some features are available only on paid plans; plans and prices are listed on our Pricing page.

We may change, add or remove features to improve the Service. If a change materially reduces what your paid plan includes, we will tell you before it takes effect.

2. Your account

• You must be at least 16 years old to use the Service, and at least 18 years old or the age of majority where you live to buy a paid plan.
• Give us accurate information and keep your sign-in details secure. You are responsible for activity under your account.
• Your account is personal. Do not share it or let others use it.
• The same account can be used to sign in to other products we operate.
• Tell us at support@karbasa.com if you think your account has been used without your permission.

3. Plans, payments and renewals

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the merchant of record for all our orders. Paddle handles payments, taxes and invoices, answers questions about orders and handles returns.

• Paid plans are billed in advance, monthly or yearly, and renew automatically at the end of each billing period until you cancel.
• Prices are shown before you pay and include applicable taxes where required. Paddle may charge you in your local currency.
• If you change plans, the change takes effect immediately. The prorated difference is charged at once or added to your balance and taken off your next invoices.
• You can cancel at any time in Admin > Billing. Your plan stays active until the end of the period you have paid for, and you will not be charged again.
• If a payment fails, Paddle will try again. If it keeps failing, your account may return to the free plan; your files are not deleted.
• Refunds are covered by our Refund Policy.

4. Your content

You keep all rights to the files, designs, assets and other material you create or upload ("your content"). We do not claim ownership of it.

You give us a worldwide, non-exclusive, royalty-free licence to host, store, copy, process, transmit and display your content only as needed to provide, secure and support the Service for you, including sending it to our service providers when you use AI features, and, while content training is on, to train and improve our AI models as described in section 5. This licence ends when your content is deleted from the Service, except for copies we must keep by law; models trained before then are not changed.

You are responsible for your content and for having the rights you need to use it.

5. AI features

• AI features may produce results that are inaccurate, unexpected or similar to other content. Review results before you use them.
• Images you send to AI features are first checked by an automated content moderation service and then processed by our AI service providers, which delete them within one hour. Requests that break these Terms are refused.
• Content training: to improve Karbasa's AI features, we may use your content to train and improve our AI models. The models learn general design patterns and how Karbasa's tools are used, not your specific content, concepts or ideas. Before training, we take steps to de-identify content and remove personal and sensitive information from text and images.
• Content training is on by default. You can turn it off at any time with the Content training switch in Admin > Settings; from then on, your content is not used in new training. Turning it off does not change models trained earlier.
• AI features may be limited by credits or quotas that depend on your plan.
• You are responsible for how you use AI results, including having the rights needed to use them.

6. Acceptable use

You agree not to:

• break the law, or infringe the intellectual property, privacy or other rights of others;
• upload or create content that is illegal, sexually exploits minors, promotes violence or hatred, or is meant to deceive, such as forged documents or impersonation;
• send malware, probe or attack the Service, or get around its security, rate limits, quotas or plan limits;
• access the Service with automated tools in ways that overload it, except through interfaces we provide for that purpose;
• resell, sublicense or share access to the Service, or use it to build a competing product.

7. Our intellectual property

The Service, including its software, design and the Karbasa name and logo, belongs to us or our licensors. These Terms give you a limited, personal and non-transferable right to use the Service and no other rights in it.

If you send us feedback or suggestions, we may use them without any obligation to you.

8. Deleting your account and termination

• You can ask us to delete your account at any time by writing to support@karbasa.com. We keep a deleted account for 30 days so that it can be restored, and then delete it and your files permanently.
• Deleting your account cancels your paid plan at the end of the current billing period.
• We may suspend or close your account if you seriously or repeatedly break these Terms, if the law requires it, or to protect the Service or other users. Where we can, we will tell you first and give you a chance to download your content.

9. Disclaimers

The Service is provided "as is" and "as available". To the extent permitted by law, we make no warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not guarantee that the Service will be uninterrupted or free of errors, so keep your own copies of important work.

10. Limitation of liability

To the extent permitted by law, we are not liable for indirect, incidental, special or consequential damages, or for lost profits, revenue or data. Our total liability for any claim relating to the Service is limited to the amount you paid for the Service in the 12 months before the claim.

Nothing in these Terms limits liability that cannot be limited by law, such as liability for gross negligence or intent, or your rights as a consumer.

11. Changes to these Terms

We may update these Terms. If a change materially affects you, we will tell you by email or in the Service before it takes effect. The date at the top of this page shows when the Terms were last updated. If you keep using the Service after a change takes effect, the updated Terms apply to you.

12. Governing law and disputes

These Terms are governed by the laws of the Republic of Türkiye. The courts and enforcement offices of İzmir have jurisdiction over disputes arising from these Terms.

If you are a consumer, this does not take away the protection of the mandatory laws of the country where you live, or your right to apply to the consumer arbitration committees and consumer courts that are competent under Turkish consumer law.
